On Fighting Terrorism

amended on the 20th of November, 2012 N 5502-VI

This law in order to protect persons, state and society from terrorism, identify and remove the causes and conditions that generate it, defines the legal and institutional framework on fighting this dangerous phenomenon, powers and duties of the executive authorities, public associations and organizations , officials and individuals in this field, the order to coordinate their activities, guarantees legal and social protection citizens due to the participation in the fight against terrorism.

The provisions of this Act shall be used as the basis for the prosecution of citizens who, acting within the law, act to protect their constitutional rights and freedoms.

The legal basis for the fight against terrorism is the Constitution of Ukraine, the Criminal Code of Ukraine, this Law and other laws of Ukraine, the European Convention on the Suppression of Terrorism, 1977, the International Convention for the Suppression of Terrorist Bombings, 1997, the International Convention for the Suppression of the Financing of Terrorism , 1999, and other international treaties of Ukraine ratified by the Verkhovna Rada of Ukraine, decrees and orders of the President of Ukraine, decrees and orders of the Cabinet of Ministers of Ukraine and other normative legal acts adopted pursuant to the laws of Ukraine.

Fighting terrorism is based on the following principles:

legality and the strict observance of the rights and freedoms of man and citizen;

integrated use for this purpose legal, political, socio-economic, outreach and other opportunities; prioritization of preventive measures;

inevitability of punishment for participation in terrorist activities;

priority of protecting the lives and rights of persons are at risk as a result of terrorist activities;

combination of overt and covert methods of fighting terrorism;

disclose information about the techniques and tactics of counterterrorism operations, as well as the composition of the participants;

unity of command in the forces and means involved to conduct anti-terrorist operations;

cooperation in the fight against terrorism with foreign nations and their law enforcement agencies and special services, as well as with international organizations engaged in the fight against terrorism.
